Suspension not a punishment but it should not be resorted as a routine.

It is settled principle of law that the appointing authority / disciplinary authority has authority to suspend an employee pending departmental inquiry. However the Apex Court in well known case of " State of Orissa v/s Bimal Kumar Mohanty has held that the order of suspension should be passed after taking into consideration the gravity of the misconduct sought to be inquired and the nature of evidence before the appointing authority/ disciplinary authority and such authority on application of mind pass the order of suspension and then consider whether it is expedient to place the employee under suspension. It should not be administrative routine or automatic order to suspend the employee.

Revised scheme for induction into IAS /IPS /IFS- Excellent Opportunity for talented young officers

The Government of India has published the revised scheme in the method of induction of SCS /Non-SCS / SPS / SFoS Officers to IAS,IPS and IFOS.

2. According to the said scheme U.P.S.C. will hold a Common Annual Examination on one single day at UPSC, New Delhi for induction to each of the ALL India Services, viz. IAS, IPS, IFOS. According to the revised scheme the selection will be made considering the marks obtained in the four components viz Written test 30%), length of service (25%), Assessment of ACRs (25%) and interview(20%) for SCS officers and for Non SCS officers Written test (55%), Assessment of ACRs(25%) and interview(20%).

3.The written examination will have following papars

Paper I - Aptitude test (Objective type questions)

Paper II -Part A- General Studies (Objective type questions)
              Part B-  State specific and service specific questions (Objective type questions)

Paper III (Only for Non SCS Officers)-   Essay, Comprehension and Essay Type

4. Minimum length of service prescribed is  8 years service in Group A in the state for all the categories.

5. Maximum Age limit will be 54 years.

6. Zone of consideration will be three times the number of vacancies in a State in respect of SCS/SPS/SFoS. In respect of Non SCS officers the screening committee constituted by the State Government for short listing  will the names of officers will forward the names to the Selection committee. The size of the short list will be 5 times of the number of.vacancies.  and 

7.The revised scheme  provides excellent opportunity to young and talented officers especially in SCS,SPS & SFoS.

Ordering fresh/ denovo inquiry,because of disagreement with findings of Inquiry officer,- illegal

The disciplinary authority , in case he differs with the findings of inquiry officer, he has to record his tentative findings with the reasons there-for and communicate them along with the Inquiry report and give an opportunity to the delinquent employee to  give his say. After considering the reply the disciplinary authority is to pass the appropriate order imposing the penalty or otherwise. It will be illegal on the part of disciplinary authority to  order a fresh / de novo inquiry just because he does not agree with the findings of Inquiry Officer.  The Supreme court in case of  K.R. Deb v/s  Collector of Central Exercise, AIR 1974 SC 1447 has laid down the said law.

Disciplinary Proceedings to impose Minor penalty and Retirement of Government Servant

As per provisions in Rule 27 of M.C.S.(Pension) Rules 1982,the State Government has a right to withhold or withdraw a pension or part thereof permanently or for a specific period also order recovery of pecuniary loss caused to Government, from the pension, if employee is found guilty of grave misconduct or negligence during his service.

The above said Rule also provides that the Departmental proceedings instituted while the employee was in service shall be continued even after his retirement and finalized in the same manner as if the employee had continued in service. The departmental proceedings mentioned here refers only to the proceedings instituted to impose Major Punishment under Rule 8 0f M.C.S.(D.&A.) Rules 1979 and not proceedings to impose Minor punishment under Rule 10 of the said Rules.

 If  disciplinary proceedings are  initiated to impose minor punishment under Rule 10 of Disciplinary rules during the service, it is obvious that employee is not alleged to have committed grave misconduct or negligence and no action can be taken to withdraw or withheld the pension of an employee as provided in Rule 27 of Pension Rules. Therefore the proceedings initiated to impose minor punishment under Rule 10 of Disciplinary Rules,  will have to be finalized before his retirement. If they could not not be finalized before the retirement, they will have to be dropped and the employee is paid all his pensionary benefits including Gratuity.

A copy  of Ministry of Home Affairs’, Department of Personnel and Administrative Reforms, Government of India, O.M. No. 134/10/80-AVD.I dated 28.2.81 clarifying the position is reproduced below.
  
Sub: Minor penalty proceedings pending against Government servants who are due to retire from the service. 
*** 
         The undersigned is directed  to say that sub-rule [1] of Rule 9 of the C.C.S. [Pension] Rules, 1972 confers on the President the right to withhold or withdraw the pension or a part thereof, either permanently or for specified period, and to order recovery from the pension, of the whole or a part of any pecuniary loss caused to the Government, if, in any departmental or judicial proceedings, the pensioner is found guilty of grave misconduct or negligence during the period of his service including service rendered upon re-employment  or retirement.  Sub-rule [2] of this rule provides that the departmental proceedings, referred to in sub-rule [1], if instituted before the retirement of a Govt. servant or during his re-employment shall after his final retirement, be deemed to be proceedings under this rule and shall be continued and concluded.  Accordingly, the minor penalty proceedings and the major penalty proceedings, which are instituted against a Govt. servant while in service and which do not get concluded before the date of retirement, automatically become proceedings under rule 9 ibid.  However, since grave misconduct or negligence cannot be established as a result of minor penalty proceedings, action under Rule 9 ibid for withholding or withdrawing pension etc., cannot be taken against a pensioner, in respect of whom minor penalty proceedings had been instituted while in service but which do not get concluded before retirement and have hence continued after retirement.  Such minor penalty proceedings continued beyond retirement,  therefore, do not literally have any effect on the pensioner in the matter of reducing or withholding of his pension.  The disciplinary authorities under the Department of Agriculture etc., are requested to take note of this position and take steps to see that minor penalty proceedings, initiated against  Govt. servants, who are due to retire, are finalized quickly and in time before the date of retirement, so that the need for continuing such minor penalties proceedings beyond the date of retirement does not arise.

A REVEALING STORY ​ABOUT THE GREAT SHIVAJI

A small country like Vietnam brought​ a Mighty USA to it's knees. President of Vietnam was asked by reporters, how could they achieve that feat ?
He replied that " I read the character & deeds of a great King, who
 inspired me to try his war tactics against the US Forces..and the success  just followed."
 When asked who was the King , he replied "Shivaji. " He further added that "had  such a King been born in Vietnam, we would have ruled the world " After the  death of the said Vietnamese President, he had it inscribed on his  tombstone " Shivaji Maharaja's One Mavla, has achived Samadhi " ( Since  Shivaji's soldiers belonged to Maval region of Maharashtra, they were  called Mavlas )
 A few years later the Vietnamese, Lady Foreign Minister visited India, and  as per SOP conducted to Red Fort and Gandhi's Samadhi. She asked where is  "Shivaji's Samadhi" ? The Govt officials went into a flutter, and replied  that " at Raigadh". She expressed her desire to visit the same. On reaching  the Samadhi at Raigadh, & paying her tributes, she picked up the soil  around the samadhi and and put it into her briefcase. When questioned by
 reporters, she answered " This soil is of land of braves..once I return to  Vietnam, I will mix it with soil of my country, so that brave people like  Shivaji will be born there
."

Last week Yashvantrav Chavan Academy of Development Administration ,pune in collaboration with Maharashtra Judicial Academy had organized a training programme in which  I had an opportunity to address the newly recruited judicial officers viz. Judicial Magistrates, on the topic of " Departmental Inquiry". During my talk I had referred the following important judgements  of  the Supreme Court/ High Court relating to topics related to Deapartmental Inquiry in the following cases.

Subject: Disclosure of personal information under the RTI Act, 2005.

The Central Information Commission in one of its decisions (copy enclosed) has held that information about the complaints made against an officer of the Government and any possible action the authorities might have taken on those complaints, qualities as personal information within the meaning of provision of section 8 (1) (j) of the RTI Act, 2005.


2. The Central Information Commission while deciding the said case has cited the decision of Supreme Court of India in the matter of Girish R. Deshpande vs. CIC and others (SLP (C) no. 27734/2012) in which it was held as under:-

“The performance of an employee/Officer in an organisation is primarily a matter between the employee and the employer and normally those aspects are governed by the service rules which fall under the expression personal information, the disclosure of which has no relationship to any public activity or public interest. On the other hand, the disclosure of which could cause unwarranted invasion of the privacy of that individual." The Supreme Court further held that such information could be disclosed only if it would serve a larger public interest.

निलंबित कर्मचारी व कार्यालयीन हजेरीपट

शासकीय कर्मचा-याला निलंबित केल्यावर , निलंबित कर्मचा-याने दररोज कार्यालयात येऊन हजेरीपटावर सही करावी असे आदेश काही शिस्तभंग विषयक अधिकारी काढतात असे निदर्शनास आले आहे.

कर्मचा-यास निलंबित केल्यावर निलंबन काळातील त्याचे मुख्यालय कोणते राहील हे निलंबन आदेशात नमूद करावे लागते. सर्वसाधरणपणे निलंबना पूर्वी ज्या ठिकाणी कर्मचारी काम करीत होता ते ठिकाण त्याचे निलंबन कळतील मुख्यालय ठरविले जाते. विभागीय चौकशीचे वेळी कर्मचा-याने ठराविक तारखेस व वेळेवर उपस्थित राहावे म्हणून त्याचे कामाचे ठिकाण मुख्यालय म्हणून ठरविले जाते.

निलंबित कर्मचा-याने दररोज कार्यालयात येऊन हजेरीपटावर सही करावी अशी अपेक्षा नसते.किंबहुना निलंबित कर्मचारी कार्यालयात आल्यास त्याला त्याच्याविरुध्च्या पुराव्यात फेरफार करण्याची संधी मिळू शकते.त्याच बरोबर निलंबित कर्मचा-यास दररोज कार्यालयात येणे हे देखील अपमानास्पद वाटते.

निलंबित कर्मचा-यास दररोज कार्यालयात येऊन हजेरीपटावर सही करावी असे आदेश काढण्याची तरतूद नियमात नाही.म्हणून असे आदेश काढणे हे नियमबाह्य व बेकायदेशीर आहे असा निर्णय आंध्र प्रदेश उच्च न्यायालयाने झोनल व्यवस्थापक , फूड कार्पोरेशन ऑफ इंडिया विरुद्ध खलील अहमद सिद्दिकी १९८२ (२) एसएलआर ७७९ (आंध्र प्रदेश) या प्रकरणात दिला आहे. संबंधितानी याची नोंद घ्यावी.

Recovery of excess payment of emoluments /allowances from employee- Can it be made ?

The question  as to whether the recovery of excess payment of emoluments /allowances can be made from the employee has been dealt with by the Supreme Court in their judgement in case of Sayed Abdul Kadir and others V/S State of Bihar

The Supreme Court referring to the earlier judgements has reiterated that no recovery of excess payment of emoluments / allowance can be made if 1) the excess payment was not made on account of any misrepresentation or fraud on the part of employee and 2) if the excess payment was  made by the employer by applying a wrong principle for calculating the pay /allowance or on the basis of a particular interpretation of rule/order, which is subsequently found to be erroneous. The court has further stated that if in a given case, it is proved the employee had knowledge that the payment received was in excess of what was due or wrongly paid, or in cases where the error is detected or corrected within a short time of wrong payment, the courts may on the facts and circumstances of any particular case may order the recovery of the amount paid in excess.

Reconstitution of Police Establishment Boards

The State Government has decided to reconstitute the Police establishment Board to make the recommendations regarding posting and transfers of Police Officers. 

The First establishment Board will be for making recommendations in respect of Police officers of the rank of Superintendent of Police and above. It will be headed by the Additional Chief Secretary (Home) with Director General of Police  as it's vice Chairman, Additional Director General Of Police ( Anti Corruption) and Police Commissioner Mumbai  will be the Members. and . Additional Director General of Police ( Establishment) will be it's e Member Secretary. 

The second Establishment Board will be for making recommendations about posting and transfers in respect of Deputy Superintendent of Police and below. The said Board will be headed by the Director General Of Police. Additional Director General Of Police ( Anti Corruption) and Police Commissioner Mumbai will be it's  Member. Additional Director General of Police (Establishment) will be the Member Secretary.

Constitution of State Police Complaints Authority and District Police Complaints Authorities A significant decision -

In view of the guidelines issued by The Supreme Court , the State Government has taken an important and significant decision to set up State Police Complaints authority and District Police Complaints authorities in the State. 

 The State Police complaints authority will inquire into the complaints and allegations of serious misconduct against the Police officers of the rank of Deputy Superintendent and above.

This authority will be headed by the retired High Court judge ,with Officer of the rank of Additional Director General of police as it's Secretary. A retired Police officer of the rank of I.G.P., Eminent person from the Civil Society and retired officer not below the rank of Secretary / Commissioner will be the member of this authority.

The District  Police Complaints authority will inquire into the complaints and allegations of serious misconduct against the Police officers and up to of the rank of Deputy Superintendent of Police.

This District authority will be headed by the retired District  judge ,with the Officer of the rank of  Deputy Superintendent  as it's Secretary.  An Eminent person from the Civil Society and retired officer not below the rank of  Superintendent will be the member Secretary .

Withholding of 10% gratuity from the retiring Central Government servants - clarification regarding.

Subject: Withholding of 10% gratuity from the retiring Government servants -
              clarification regarding.

The undersigned is directed to refer to this Department's OM of even number dated the 19th
February 2013 on the above cited subject and to say that this Department is still receiving
representations from individuals and Pensioners Associations that Government Departments have
been withholding 10% of the amount of gratuity from retirees even when they had not been
provided any Government accommodation. This is in contravention of existing instructions.
2 The recovery and adjustment of Govt. dues from retirement gratuity is regulated under Rules
71 to 73 of the CCS (Pension) Rules, 1972. Rule (1) to (3) of Rule 72 ibid provide for recovery of
actual amount of Govt. dues in respect of Govt. accommodation from pay & allowances before
retirement and from Retirement Gratuity. Sub rule (5) of Rule 72 ibid stipulates that if, in any
particular case, it is not possible for the Directorate of Estates to determine the outstanding licence
fee, that Directorate shall inform the Head of Office that ten per cent of gratuity may be withheld
pending receipt of further information. Further, if no Government accommodation is allotted to a
Government servant, in accordance with Dte of Estate's OM NO.18011/5/1990-Pol-1I1 dated
12.10.2010, it is for the Administrative Ministry to issue an 'NDC".

3. As regards recovery in respect of 'Govt. dues' other than those pertaining to Govt.
accommodation, the Head of Office is required to complete assessment of such dues eight months
prior to the date of retirement [Rule 73(2)]. The actual amount of such dues and the dues which
come to notice subsequently and remain outstanding are to be adjusted against the amount of
retirement gratuity becoming payable to the Govt. servant on retirement.

4. It is, therefore, clear that there is no provision for withholding any part of gratuity at the
time of retirement for the purpose of recovery of outstanding government dues other than those
pertaining to government accommodation and the onus of timely collection of license fee is on the
Directorate of Estates. If the Directorate of Estate does not specifically inform the Administrative
Department of the outstanding dues and requests for withholding of 10% gratuity for the
outstanding license fee, Gratuity cannot be withheld on this account. The only other circumstance
under which gratuity can be withheld is in case of ongoing disciplinary proceedings against the
Government servant. Thus the Pay and Accounts Officer shall not withhold any gratuity unless
the Head of Office
(a) encloses instructions received from Directorate of Estate for withholding of 10%
gratuity for outstanding license fee or
(b) Informs of ongoing disciplinary proceedings.

These instructions are for strict compliance of all Administrative Ministriesl Departments.

5. A revised FORM 8 - form of letter to the Accounts Officer forwarding the pension papers
of Government servant is also enclosed. Formal amendment in the CCS(Pension) Rules for revised

OFFICE MEMORANDUM

Subject :- Revision of income criteria to exclude socially advanced persons/sections (Creamy Layer) from the purview of reservation for Other Backward Classes (OBCs)-reg.

The undersigned is directed to invite attention to this Department’s office memorandum No.36012/22/93-Estt. (SCT) dated 8th September, 1993 which, inter-alia, provided that sons and daughters of persons having gross annual income of Rs.1 lakh or above for a period of three consecutive years would fall within the creamy layer and would not be entitled to get the benefit of reservation available to the Other Backward Classes. The aforesaid limit of income for determining the creamy layer status was subsequently raised to Rs. 2.5 akh and Rs. 4.5 Iakh and accordingly the expression “Rs.1 lakh” under Category-VI of Schedule to OM dated 8th September, 1993 was revised to “Rs. 2.5 lakh” and to “RS. 4.5 lakh” vide this Department’s OMs No. 36033/3/2004-Estt. (Res.) dated 09.03.2004 and dated 14.10. 2008 respectively.

2. It has now been decided to raise the income limit from Rs. 4.5 lakh to Rs. 6 lakh per annum for determining the creamy layer amongst the Other Backward Classes. Accordingly, the expression “Rs. 4.5 lakh” under Category VI in the Schedule to this Department’s aforesaid O.M. of 8th September, 1993 would be substituted by Rs. “Rs. 6 lakh”.

3. The provisions of this office memorandum have effect from 16th May, 2013.

4. All the Ministries/Departments are requested to bring the contents of this office memorandum to the notice of all concerned.

Difference between " Quorum and Coram "

A quorum is the minimum number of people who must be present to pass a law, make a judgment, or conduct business. Quorum requirements typically are found in a court, legislative assembly, or corporation (where those attending might be directors or stockholders). In some cases, the law requires more people than a simple majority to form a quorum. If no such defining number is determined, a quorum is a simple majority.


The term coram is used in phrases that refer to   a group.or bench of  specified judges.

Difference between 'Inquiry' and 'Enquiry'

'Inquiry' and 'enquiry' are interchangeable in the US and the UK. However, in the UK, it is becoming preferable to use 'inquiry' to denote 'an investigation' and 'enquiry' to denote 'a question'.In India both the words are used to carry the same meaning as done in U.K. The word ' Inquiry' is used in relation to a formal 'inquiry' whereas the word 'enquiry' is used to denote ' the act of questioning.Therefore in case of departmental proceeding the word used is 'Inquiry' indicating that it is a formal inquiry.

Subject: Extension of RTI web portal for online filing of RTI application.
In continuation of this Department’s O.M. of even number dated 22/04/2013, ¡t is intimated that training to RTI Nodal Officers, RTI Cell officials and NIC/IT personnel attached with Ministries/Departments of Government of India have been completed by DoPT with the help of NIC.
2. It is again requested that training to all the CPlOs and First Appellate Authorities (FAAs) may be provided by the concerned Ministry/Department, through the officials trained by DoPT/NIC, User name/password to all the CPIOs and FAAs are to be provided by RTI Nodal Officers of the concerned Ministry/Department. It is imperative that the RTI Nodal Officers start updating the details of CPIOs / FAAs in the system and issue user name and password to them at the earliest.
3. As mentioned in the said O.M., it is planned to extend the facility of RTI online web portal to all the Ministries/Departments of Government of India. This facility is being extended to Ministry of Home Affairs, Department of Agriculture and Cooperation, Department of Animal Husbandry, Dairying and Fisheries and Department of Consumer Affairs and Department of Food and Public Distribution from 22 May 2013.

REVISION OF INCOME CRITERION TO EXCLUDE SOCIALLY ADVANCED PERSONS/ SECTIONS (CREAMY LAYER) FROM LIST OF OTHER BACKWARD CLASSES (OBCS)


The Union Cabinet today gave its approval for increase in the present income criterion of Rs. 4.5 lakh per annum for applying the Creamy Layer restriction throughout the country, for excluding Socially Advanced Persons/Sections (Creamy Layer) from the purview of reservation of Other Backward Classes (OBCs).
The new income criterion will be Rs. 6 lakh per annum. The increase in the income limit to exclude the Creamy Layer is in keeping with the increase in the Consumer Price Index and would enable more persons to take advantage of reservation benefits extended to OBCs in government services and admission to central educational institutions.
This would bring about equity and greater inclusiveness in society. The Department of Personnel and Training and the Ministry of Human Resource Development would issue necessary orders to this effect.

8% increase in D.A. to State Government employees w.e.f. 1-1-2013


राज्य शासनाने  शासकीय कर्मचा-यांच्या  व इतर पुर्णकालीन पात्र कर्मचा-यांच्या  महागाईभत्त्यात १-१-२०१३ पासून ८ %वाढ केली आहे . म्हणजेच मूळ  वेतनावरील (ग्रेड पे सह ) अनुद्नेय महागाई  भत्त्याचा दर               १- १- २ ० १ ३  पासून ७२ % वरून ८० % करण्यात आला  आहे . 

सदर महागाई भत्ता  रोख रकमेत देण्यात येणार आहे .  

१ जानेवारी ते  ३ ० एप्रिल या काळातील थकबाकी देण्याचे आदेश स्वतंत्र पणे काढले जाणार आहेत .

"The Sexual Harassment at workplace (Prevention, Prohibition and Redressal ) Act 2013 " .


The Government of India has enacted an Act known as "The Sexual Harassment at workplace (Prevention, Prohibition and Redressal ) Act 2013 " . The said Act has appeared in Government Gazette dated  23 rd April 2013. The Act will come into effect shortly on the date that will be notified  in the Gazette.

 The copy of the said Act is available on this blog in the material on "sexual harassment at work place " in the column titled "Worth Visiting ". Those who are interested can get it downloaded.

8% D.A.Increase for Central Government Employees


The Dearness allowance for central Government employees has been increased by 8% from 1 st January 2013. The total D.A. for them will be now 80 % of their pay and pension in respect of pensioners.

 This was long awaited and the employees had started the agitation for Grant of this installment of  D.A.

Kerala tops all states in India in terms of the per capita expenditure on medicine. But the state is also a good example of how government efforts can serve as a foil for rising prices of essential drugs.

The Kerala Medical Services Corporation Ltd (KMSCL), a government-owned enterprise, offers life-saving drugs at substantially lower costs — in some cases at one-sixth of the market price — compared with the retail market (see Huge Difference).

How so? KMSCL procures medicines in bulk and drives a hard bargain while negotiating prices with drug companies. By engaging directly with these companies, the enterprise has eliminated middlemen altogether. As any successful business would tell you, that helps keep a tight lid on costs.

KMSCL sells medicines through a chain of stores called Karunya. It has so far opened five medical stores at five medical colleges in the state.

That's a small number, but the impact of these stores is reflected in the turnover — Rs 32 crore a year — from a single outlet at the Thiruvananthapuram Medical College, according to Biju Prabhakar, managing director of KMSCL.

When the first outlet opened in Thiruvananthapuram, which is in the southern tip of Kerala, people from the Malabar region (the north) travelled all the way to the outlet to procure medicines.

भ्रष्टाचाराच्या आरोपावरून भारतीय पोलीस सेवेतील अधिका-यास शिक्षा


भ्रष्टाचाराच्या आरोपावरून श्री. जैन या महाराष्ट्रातील भारतीय पोलीस सेवेतील अधिका-यास मुंबई येथील सेशन कोर्टाने  ५ वर्षांची सक्तमजुरीची शिक्षा सुनावली . ४ दिवसापूर्वी ठाण्यातील मुंब्रा भागातील अनधिकृत  इमारत कोसळून सुमारे ७५ लोकांचा  मृत्यू झाला . अनधिकृत इमारत बांधण्यासाठी लोकनियुक्त पुढारी तसेच उपायुक्त दर्जाचे अधिका -यांनी मोठ्या प्रमाणात लांच  घेतली होती असे प्राथमिक चौकशीत आढळून आले आहे 

 भ्रष्टाचारामुळे समाजाचे अतोनात  नुकसान होत आहे . राष्ट्राचा विकास खुंटला आहे . 

भ्रष्टाचाराचा राक्षस गाडून टाकण्याची शपथ  गुढी पाडव्याच्या शुभ मुहूर्तावर आपण सर्वांनी घेऊ या व ती प्रत्यक्षात येईल यासाठी सतत प्रयत्नशील राहू या . 

गुढी पाडव्याचा सर्वाना हार्दिक शुभेच्छा व भ्रष्टाचाराचे  निर्मूलन  करण्यात आपणा  सर्वांस यश मिळो ही  प्रार्थना

Denied promotion ,Employee can claim it even after retirement with all monetary benefits

If an employee is denied eligible promotion while in service, he will be entitled for notional promotion with all the monetary benefits even after the retirement, the Kerala High court has ruled in the case of Joseph John of Government aided Aquinas college of Edakochi.

The petitioner was denied promotion to the post of Superintendent, which he had challenged in High Court. He retired while his writ petition was pending in High court. The High Court while hearing the case found that he had a rightful claim which was wrongly denied by the authorities concerned. The High Court held that since the petitioner's rightful claim was denied , he should be given the notional promotion and granted all the monetary benefits which he would have have been granted had he been in service.

२६ नोव्हेंबर २००८ रोजी मुंबई शहरावर झालेल्या अतिरेकी हल्ल्याचा तपास करणा-या अधिका-यांना व कर्मचा-यांना रोख बक्षिसे जाहीर


२६ नोव्हेंबर २००८ रोजी मुंबई शहरावर पाकिस्तानातील अतिरक्यांनी हल्ला केला होता.त्यामुळे मुंबई शहरात तसेच संपूर्ण देशात भीतीचे व असुरक्षिततेचे  वातावरण निर्माण झाले होते. यासंदर्भात विविध पोलिस  स्टेशन्स मध्ये एकूण १२ गुन्हे नोद्विण्यात आले होते.सदर गुन्ह्यात एक जिवंत अतिरेकी महंमद अजमल महमद कसाब सापडला होता . त्याला नुकतीच फाशी देण्यात आली.

वरील गुन्ह्यासंदर्भात अत्यंत कठोर परिश्रम घेऊन सखोल चौकशी करणा-या सर्वश्री राकेश मारिया व देवेन भारती या भारतीय पोलिस सेवेतील अधिका-यांना प्रशस्तीपत्रके व महाराष्ट्र पोलिस सेवेतील अधिक-यांना व पोलिस कर्मचा-यांना ६.५८ लाखाची रोख रकमेची बक्षिसे राज्यशासनाने नुकतीच जाहीर केली  आहेत.

स्वत:चा जीव धोक्यात घालून जनतेचे संरक्षण करणाऱ्या व बक्षीस प्राप्त करणा-या अधिका-यांचे व कर्मचा-यांचे हार्दिक अभिनंदन. चांगल्या कामगिरीबद्दल संबंधितांचे कौतुक करून त्यांना प्रोत्साहन देणा-या राज्यशासनास धन्यवाद.

Electronic Postal Order introduced – To Benefit Information Seekers under RTI ACT

Subject :  Electronic Indian Postal Order — launching of.
On the initiative of Department of Personnel and Training, Department of Posts has launched a service called "eIPO (Electronic Indian Postal Order) w.e.f. 22.03.2013. This is a facility to purchase an Indian Postal Order electronically by paying a fee on-line through e-Post Office Portal i.e. http://www.epostoffice.gov.in. It can also be accessed through India Post website www.indiapost.gov.in . As per RTI Rules, 2012, fees may be paid by electronic means, if facility for receiving fees through electronic means is available with the public authority.
2. At present, this facility is provided only for Indian Citizens abroad across the globe to facilitate them to seek information from the Central Public Information Officers (CPIOs) under the RTI Act, 2005, Debit and Credit cards can be used to purchase eIPO.
3. The user needs to get himself registered at the website. He has to select the Ministry/Department from whom he desires to seek the information under the RTI Act and the eIPO so generated can be used to seek information from that Ministry/Department only. A printout of the eIPO is required to be attached with the RTI application. If the RTI application is being filed electronically, eIPO is required to be attached as an attachment.
4. It may be noted that this facility is only for purchasing an Indian Postal Order electronically. All the requirements for filing an RTI application as well as other provisions regarding eligibility, time limit, exemptions etc., as provided in the RTI Act, 2005 will continue to apply.
5. An eIPO generated must be used only once with an RTI application. To check any multiple use of the same eIPO, the CPIOs shall maintain a record of the eIPOs so received from Indian Citizens abroad. In case of any doubt, the details of eIPO can be verified from the above mentioned site/portal of India Post.

१ जुलै २० १ २ ते ३१ ऑक्टोबर २० १ २ या कालावधीची महागाई भत्त्याच्या थकबाकीची रक्कम रोखीत मिळणार


राज्य शासकीय कर्मचारी  इतर पात्र  पूर्णकालिक कर्मचा-यांना १जुलै २०१२  पासून अनुद्नेय महागाई भत्त्याचा दर ६५ टक्के पासून ७२ टक्के करण्यात आला आहे . तसेच . 1 नोव्हेंबर, 2012 पासून सदर महागाई भत्त्याच्या वाढीची रक्कम रोखीने देण्यात आली आहे.

2. राज्य शासकीय कर्मचारी  इतर पात्र  पूर्णकालिक कर्मचा-यांना 1 जुलै  2012 ते  31 ऑक्टोबर, 2012 या कालावधीतील  महागाई भत्त्याची थकबाकीची  रक्कम रोखीने देण्यात यावी  असे .आदेश शासनाच्या वित्त विभागाने दि. ५-३ -२०१३ च्या शासन निर्णयाद्वारे काढले आहेत .

दिनांक १ जानेवारी २००६ नंतरच्या निवृत्तीवेतन धारकांना / कुटुंबनिवृत्तीवेतनधारकांना द्यावयाचे किमान निवृत्तीवेतन

दिनांक 1.1.2006 रोजी किंवा त्यानंतर सेवानिवृत्त झालेल्या / मृत पावलेल्या ज्या प्रकरणांत निवृत्तीवेतनधारकांचे / कुटुंब निवृत्तीवेतनधारकांचे निवृत्तीवेतन /कुटुंब निवृत्तीवेतन वेतन सहाव्या वेतन आयोगानुसार रु.१९१३/-पेक्षा कमी निश्चित होईल, अशा सर्व प्रकरणांत संबंधिताना रु.१९१३/- एवढे निवृत्तीवेतन /कुटुंब निवृत्तीवेतन अदा करण्याचा निर्णय शासनाने दिनांक १६ फेब्रुवारी २०१३ च्या शासन
निर्णयाद्वारे घेतला आहे..

केंद्र शासनाच्या कर्मचा-यांना मात्र रु. ३५०० एव्हढे किमान  निवृत्तीवेतन दिले जाते.

Cut off date fixed by Govt. of Maharashtra for payment of Gratuiety held unconsttitutional by Supreme Court

The State Government had increased the ceiling limit of retirement gratuity and death cum gratuity from Rs. 3.5 lakhs to Rs. 5 lakhs vide G.R. dated 5th May 2009 These limits were made applicable to  university and college teachers and others to whom the M.C.S.(pension) Rules are made applicable. In the light of the 6 th pay commission recommendations the said limit of Rs.5 lakhs was increased to Rs. 7 lakhs vide G.R. dated 21 st August 2009. However this was made effective from September 2009.

The association of retired university and college teachers   had challenged the said resolution dated 21 st August 2009 by filing a writ petition in  Aurangabad  Bench of Bombay High Court. The said petition was dismissed by the High court. The association had challenged the decision of High Court by filing a special leave petiotion in the Supreme Court. The said pettion was allowed by the Supreme Court setting aside the order of the High Court.

The supreme court declared the cut off date fixed by by the Govt . in their G.R. dated 21 st August 2009 as unconsttitutional and held that the employees governed by the G.R. dated 5 th May 2009 are also entitled to the benefit of enhnanced gratuity of Rs. 7 lakhs. The Supreme court further directed that the appelant and other similarly situated employees should be paied the differenece of Gratuity already paid and the enhanced gratuity payable in terms of G.R. dated 21 st August 2009.

This decision will benefit the State Government employees and other employees to whom .M.C.S.(pension) Rules 1982 are applicable and who are retired between 1-1-2006 and 1-9-2009.

Need to avoid the use of term “Harijan” in respect of Scheduled Castes ¡n official communications and transactions

Subject: Need to avoid the use of term “Harijan” in respect of Scheduled Castes ¡n official communications and transactions.
Sir,
‘I am directed to refer to the Ministry of Home Affairs (MHA) letter No. BC 12025/44/80-SC&BCD.I/IV, dated 10.02.1982, in which all the State Governments / Union Territory Administrations were requested to issue instructions to the authorities who were empowered to issue the Scheduled Castes certificates, not to insert the word ‘Harijan’ in the Scheduled Caste certificates, but to mention only the name of the caste to which the person belongs. Subsequently the Ministry of Welfare (now Social Justice and Empowerment), vide letter No. 12025/14/90-SCD(R.L.Cell), dated 16.08.1990, had again requested the Chief Secretaries of all State Governments/Union Territory Administrations, that for all official transactions, matters, dealings, certificates etc., the Constitutional term, ‘Scheduled Caste’ in English and its appropriate translation in other national languages should alone be used for denoting the persons belonging to the Scheduled Castes included in the Presidential Orders issued under Article 341 of the Constitution. The State Governments / U.T.Administrations were also requested that in the names of departments, which are in overall charge of development/welfare of Scheduled Castes, the term ‘Harijan’ etc. should not be used.
2. The Parliamentary Standing Committee on Social Justice and Empowerment. in its Ninth Report presented to Lok Sabha and laid in Rajya Sahha on l9.08,2010, inter-alia observed as follows:
"…..the circular issued way back in 1982 is very old which has lost its sanctity and purpose leading to its non compliance…. As such, there is widespread use of the word ‘Harijan’ across the country deprecating the status of the underprivileged sections of the society“.
Accordingly, the Committee has recommended that this Ministry issue fresh guidelines, instructions to States/ U.Ts directing them to ensure the non-use of the word “Harijan” not only in caste certificates but also otherwise.
3. All the State Governments/U.T. Administrations are again requested that for all office transactions, matters, dealings, certificates etc.. the Constitutional term. ‘Scheduled Caste’ in English, and its – appropriate translation in other national languages should alone be used for denoting the persons belonging to the Scheduled Castes included in the Orders issued by the President under Article 341 of the Constitution of India.
4. Action taken on the above may kindly be intimated to the undersigned.
